| My fiance has the issue of our employer keeps taking his hours away from him. For instance he will work from 5 to 11:30, but since he is closing down the place, he might clock out at 5 til 12 or so. Well our employer started going in on our time clock and rolling his hours back so it's as if he never worked them. Is that legal for her to do or is she required to pay him for those hours. |

In everystate there is minimum computation time. In california I believe it is 2 minutes. THat means you must be paid for every two minutes of work one does.
Rolling back the clock does not make much sense to me... Are you saying that she actually changed the timecard entries? That would not be lawful. _________________ Nothing intended as legal advice.

That is strange. I think in South Dakota, its every 15 min, then you move the the next half-hour. I learned a long time ago, you can never make money working for someone else per hour.
Call the department of labor in your state. Report this employer, and chances are you will get paid for the hours taken off. Chances are good this employer will get a stiff fine for this BS. |

Well say my fiance is busy that night and clocks out at like midnight instead of 1103 or something like that...she will go in and change his time card entry to make it seem like he clocked out earlier than he did. For instance her time clock entry will then show that he clocked out at 1130 instead of midnight. |

Call the Department of Labor. They will advise you/him. An employer doesn't want problems with the DoL. They should have a form one fills out, and then they will take care of it. Thats what they are there for, to help you. |
