Avoiding discovery is number one and tactic is used by defendants in a civil action. This is why you must begin your discovery immediately. In some cases you can begin discovery before you even file a case.

Discovery involves production of documents, copies records on computer including e-mails, tax records and testimony in form of depositions.

Depositions can be oral or written. Written ones are called interrogatories.

Could you provide examples of cases that you could do this?

Apperently, you can in Federal Cases. What about state? I live in Montana, and the MCA doesn't explain this very well.

Speaking of interrogatories: Lets say you wanted to get info. from witnesses that are not being very helpfu. Could you use this tactic to get your info. before filing your action? This could be very helpfull if they are scared and won't budge.
