My husband is out of work and is job hunting. He found out that a previous employer who he worked for several years ago, is telling potential employers who request a reference, that my husband never worked for them. My husband worked for that employer for 3 1/2 years, and has paycheck stubs, W2 statements, and tax returns showing that he did work for that employer during that time. Does he have a defamation case against his previous employer for lying about him?

Is there a loss because of it?

They have employment info on here, check it out. Perhaps buy the book they have.

I would just leave that person off the list lol. I would email uslawbooks.com, and ask one of them. Perhaps they can point you in the right direction.

You might be able to get some kind of an injunction against the former employer, or perhaps get all of the work records and take them to each interview.

If he can prove that it was said to potential employers then yes that would be a loss. Loss of prospective employment is even a loss and this is definitly loss of employment prospectives and it is provable.

I sued out for the loss of partial use of a finger as potential future employment even though it was not as essential at the time to my work at hand (no pun intended.)

My husband hired a reference checking company to contact his previous employer for a reference, and get what they say in writing. My husband was laid off from a job (not the same company that is claiming he never worked for them) at the end of August 2006, when his company downsized. He has been on dozens of interviews, and has applied for countless jobs, but no one will hire him. He has never had this much trouble in the past finding a job, as he has 10+ years experience in the field he works in. He knows for certain that many of the employers where he interviewed went through the reference checking process, but then did not offer him a position. He truly believes this is because of that other previous employer lying and saying that he never worked for them. Now his unemployment pay is about to run out in two weeks, and he has no job offers in sight.. Thank you for the information, because now if we get something in writing from that old employer saying that my husband never worked for them, we are definitely going to take it to an attorney.
